Regulatory framework for intelligent health governance in Iranian law: Considering knowledge-based technologies in traditional medicine, indigenous culture, and passive defense
Iman Mokhtari *
Abstract:   (447 Views)
This study develops an indigenous regulatory framework for intelligent health governance in Iranian law, with particular emphasis on knowledge-based technologies in traditional medicine, indigenous culture, and passive defense requirements.  The research issue pertains to the absence of a cohesive framework for regulating health data based on traditional medicine, validating artificial intelligence systems, and determining the legal responsibilities of stakeholders in this field, alongside the lack of regulations governing data protection and health infrastructure. Given that the development of knowledge-based technologies in traditional medicine relies on processing vast amounts of health data and utilizing intelligent systems, maintaining confidentiality, integrity, and continuous access to this data-considered essential for non-military defense-has become a cornerstone of regulation in this domain. The research employs a descriptive-analytical method based on document analysis, revealing that the lack of a legal definition for traditional health data, the absence of standards for algorithm evaluation, the fragmentation of regulatory authority, and neglect of defense requirements in the design and operation of intelligent health systems have diminished the effectiveness of health governance and increased legal and security risks. Consequently, the research proposes the establishment of a specialized legal framework for traditional health data, the validation of artificial intelligence algorithms, and the integration of defense requirements into the regulation of health technologies as fundamental components of the proposed model.
